Please read these Terms of Service (“Terms”) carefully before using the services provided by Lake Computer Services Ltd (“we,” “us,” or “our”). These Terms constitute a legally binding agreement between you and Lake Computer Services Ltd regarding your use of our website management services.

Acceptance of Terms

By using our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our services. Failure to comply with these terms of service will result in the early termination of your management services contract with us and any costs associated with the offboarding of services will be the responsibility of the client.

Description of Services

Lake Computer Services Ltd provides website management services, including but not limited to website design, development, maintenance, and support. We may also offer additional services or features in the future, which will be subject to these Terms.

Payment

We only accept payments for our services through PayPal. By using our services, you acknowledge and agree that you are solely responsible for ensuring that your PayPal account is active and in good standing. We do not accept payments in the form of cash, check, or money order. Any payments made without prior authorization using methods such as checks or money orders will incur a $35 service fee, applied to you next invoice.

Service Fees

The fees for our services are outlined in your Managed Services Agreement and are subject to change at our discretion after the 12 month term of your initial Managed Services Agreement has concluded. You agree to pay all applicable fees associated with the services you receive from us. Failure to make timely payments or payments made outside of Paypal may result in the suspension or termination of your account.

Prohibited Content

You agree that you will not use our services to display or distribute any content that is illegal, obscene, defamatory, or violates any applicable laws or regulations. Furthermore, you explicitly acknowledge and agree that the use of pornographic images or any sexually explicit content is strictly prohibited on websites managed or hosted by Lake Computer Services Ltd. We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated this provision.

Refunds

ALL SALES ARE FINAL. All sales related to the Support and Management services provided by Lake Computer Services Ltd are final. Payments for these services are made on a month-to-month basis in advance. Therefore, no refunds will be issued for the services once payment has been made. By utilizing our services, you acknowledge and agree that all payments are non-refundable. In the event that you initiate a charge-back, you will be held responsible for any fees imposed by financial institutions or payment processors as a result.

Intellectual Property

All intellectual property rights, including copyrights, trademarks, and any other proprietary rights, associated with our services and materials provided by us, are the sole property of Lake Computer Services Ltd. You may not use, modify, distribute, or reproduce any of our intellectual property without prior written consent.

Limitation of Liability

In no event shall Lake Computer Services Ltd be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services. We shall not be held responsible for any damages resulting from the use or inability to use our services or from any content displayed on our website.

Termination

We reserve the right to suspend or terminate your access to our services at any time and for any reason without prior notice. Upon termination, your right to use our services will immediately cease, and any remaining fees may become due and payable.

Changes to the Terms

We reserve the right to modify or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for any changes. Your continued use of our services after any modifications to the Terms constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Lake County or Painesville, Ohio.
